Terms of Service

These Terms of Service ("Terms") govern your use of ThisTune.com and the services provided by ThisTune ("ThisTune," "we," "us," or "our"). By placing an order or using the service, you agree to these Terms. Please read them carefully.

1. The service

ThisTune creates personalized songs based on the story, details, and preferences you provide. Songs are produced using music-generation technology that creates lyrics and music together in the style you select.

2. Eligibility

You must be at least 18 years old, or use the service with the involvement and consent of a parent or legal guardian, and you must be able to form a binding contract to use ThisTune.

3. Orders and payment

Prices are shown at checkout and charged as a one-time payment per order through our third-party payment provider. You authorize us to charge the amount shown. All orders are subject to our Refund Policy.

4. Your content and responsibilities

By submitting a story, details, lyrics, or other content, you represent and agree that:

• You have the right to submit it and to have a song created from it.
• It does not infringe anyone's intellectual property, privacy, or other rights.
• It is not unlawful, hateful, harassing, defamatory, or otherwise objectionable.
• It does not sexualize, endanger, or exploit minors in any way.

We may decline, cancel, or remove any order or content that violates these Terms, and we may report unlawful content to the appropriate authorities.

5. What you receive and your license

Subject to these Terms and full payment, the songs you receive are licensed to you according to the package you purchase:

• Standard: a license for personal, non-commercial use.
• Premium: a license for commercial use, in addition to personal use.

Because songs are produced using AI music-generation technology, you acknowledge that AI-generated output may not be eligible for copyright protection and may not be unique or exclusive to you. We do not guarantee that your song, or any portion of it, is original, exclusive, or registrable for copyright, and your license is a right to use the songs as described above rather than a transfer of exclusive ownership.

6. Acceptable use

You agree not to misuse the service, including by attempting to disrupt it, reverse engineer it, resell access to it, or use it to create content that violates Section 4. Use of your songs must comply with the license for your package and with applicable law.

7. Our intellectual property

The ThisTune name, logo, website, and underlying systems are owned by us or our licensors and are protected by law. These Terms do not grant you any rights in our brand or platform beyond using the service as intended.

8. Third-party services

The service relies on third-party providers for payments, email, hosting, and music generation. Your use of the service may also be subject to those providers' terms, and we are not responsible for their acts or omissions.

9. Disclaimers

The service and all songs are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that results will meet your expectations or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, ThisTune will not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the service will not exceed the amount you paid for the order giving rise to the claim.

11. Indemnification

You agree to indemnify and hold ThisTune harmless from claims, damages, and expenses arising out of the content you submit, your use of the songs or service, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the "last updated" date above will reflect the most recent revision. Continued use of the service means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there.
